المحاميان من الأقصر المتورطان في عملية إحتيال
مرة أخري تكون الأقصر مركز إهتمام و ذلك بسبب واقعة التدليس علي مستثمر أجنبي حيث قام محاميه بإقناعه أن يوقع عقد مبيعات مزور و الذي أدي الي فقد أرضه تقدر بحوالي 600000 جنيه التي عرضها للبيع في الأقصر –هناك ثلاث محتالين في هذه الحادثة المذنب الرئيسي هو من لعب دور المشتري في عملية التدليس المتعمدة و هو شخص معروف بالتدليس و محل إقامته في شارع عبد الحميد العمدة في الأقصر إسمه/ أشرف عزت محمد الأمير –الشخصان المذنبان الآخران هما محاميان غير جديران بالثقة يقيمان أيضا في الأقصر إسم الأول/ علاء محمد هاشم و الثاني/ محمد عبد الحافظ عبد الباقي و لكن الجزء الصادم في هذه الواقعة أن المحامي محمد عبد الحافظ عبد الباقي هو في نفس الوقت محامي الشخص الأجنبي
كيف نجح هؤلاء في تنفيذ تلك الواقعة هو أمر بسيط للغاية المحاميان الإثنان علاء محمد هاشم و محمد عبد الحافظ عبد الباقي إجتمعا سرا بغرض إعداد عقد بيع مزور يحتوي علي بنود و شروط محددة بحيث اذا تم التوقيع يترتب عليه تلقائيا أن يفقد الأجنبي أي حق له في أرضه التي يمتلكها و بالتالي فإن الخطة التي وضعوها هي أن يقوم الأجنبي بالتوقيع علي الوثيقة المزورة بالطريق القانوني لكي يستحيل تعقب الجناة بعد ذلك
لسوء الحظ كل شىء تم حسب المخطط الذي رتبه الجناة حيث حضر الأجنبي الي مكتب المحامي في شارع كيمو و حيث أنه يثق في محاميه فإنه قام بالتوقيع علي عقد البيع بدون أدني تردد و بالتالي أصبح المالك الجديد للأرض هو أشرف عزت محمد الأمير و في المقابل حصل الأجنبي علي شيك مصرفي و ذلك بعد أن أقنعه المحامي أن يقبل الشيك المصرفي بدلا من السداد نقدا
الشىء الذي لا يعرفه الأجنبي هو أن الطرف المشتري في العقد " أشرف عزت محمد الأمير قام بإمضاء إسمه علي الشيك مستخدما قلم خاص يحتوي علي حبر سري و الذي يختفي بعد ساعة من التوقيع و هذا يعني أن الأجنبي فقد حقوقه في ملكية الأرض دون أن يتحصل علي مليم واحد
و مع ذلك و يرجع الفضل للنظام القضائي المصري النزيه تم تكريس الجهود منذ حدوث هذا المشهد المخزي أول شىء فعله الأجنبي بعد الإبلاغ عن عملية التدليس للسلطات المصرية هو إستبدال محاميه بآخر و في الواقع المحامي الجديد يعمل حاليا في إتخاذ الإجراءات القانونية لإبطال عقد البيع المزور حتي يرد ملكية الأرض للمالك القديم في أقرب وقت
الي المدي المتورط فيه المحتالين أشرف عزت محمد الأمير مؤخرا تم الحكم عليه ب4 شهور لإدانته بالتزوير بعد الطعن في الحكم ب3 سنوات مع ذلك المحامي علاء محمد هاشم لم يتم إدانته حتي تاريخه و لكنه شوهد في عدة مناسبات وهو يحاول أن يفلت من توجيه التهمة الجنائية له من خلال الطرق القانونية المختلفة و المناورات في آخر دقيقة في سبيل إكتساب وقت أطول و بالتالي تأخير إدانته بإرتكاب جريمة التزوير و التدليس حيث أنه في حالة إدانته بإرتكاب الجرم سيتم وضعه في السجن لمدة تصل ثلاث سنوات و يجوز شطبه و منعه من مزاولة مهنة المحاماة نهائيا
بالرغم من ذلك المحامي محمد عبد الحافظ عبد الباقي أوفر حظا لقد إستطاع الهروب من إدانته الجنائية حيث أن لسوء الحظ الأجنبي لم يتمكن من تدبير الشاهدين الإثنين في دعواه اللازمين لنظر الدعوي و بالتالي لم يكن هناك خيار آخر أمام الأجنبي سوي أن يستخدم محمد عبد الحافظ عبد الباقي كشاهد و هذا معناه أن محامي الأجنبي الذي قام بالغش و التدليس تم إعطاه دور الشاهد بدلا من المحتال
ربما سوف نشاهد المحاميين الإثنين في محكمة الأقصر يمثلان عملائهما كأن شيء لم يحدث قط – السفارة البريطانية في مصر كتبت مذكرة في القسم القنصلي تحذر الرعايا الأجانب بإتخاذ الحيطة و الحذر أثناء التعامل مع هذين الشخصين و أيضا عدد من المحامين من الأقصر و الغردقة –أي تعليقات أو معلومات بخصوص تلك المسألة ترسل علي الموقع [email protected]

Two Luxor lawyers involved in nasty scam
One more time, Luxor is the center of attention after a foreign investor was cheated after being convinced by his own lawyer to sign a fraudulent sales contract which made him lose his 600 000 LE land that he was trying to sell in Luxor.
In this occurrence, there are 3 offenders. The main offender, who played the role of the buyer in this particular premeditated scam, happens to be a very famous fraudster who lives in Abdel Hamid el Omda street in Luxor called Ashraf Ezzat Mohammed el Amir. The other two offenders are two untrustworthy lawyers who are also from Luxor, whose names are Alaa Mohammed Hashim and Mohammed Abdel Hafiz Abdel Baki; but the most chocking part in this story, is that lawyer Mohammed Abdel Hafiz Abdel Baki, happened, at the time, to be the lawyer of the foreigner.
How they managed to succeed in this unfortunate incident was very simple. Both lawyers, Alla Mohammed Hashim and Mohammed Abdel Hafiz Abdel Baki, secretly got together in order to carefully prepare a fraudulent sales contract with extremely specific terms that, if signed, would automatically make the foreigner lose all his rights on his own land; so their plan was to have the foreigner sign that particular fraudulent document, the legal way so that the perpetrators cannot be prosecuted afterwards.
Unfortunately, everything went almost as planned for the perpetrators as, the foreigner eventually show up at his lawyer’s office on Kimo street, and since he trusted his lawyer, he finally signed the sales contract without hesitation with means that the new owner of the land was then Ashraf Ezzat Mohammed el Amir. In exchange, the foreigner received a bank check, as his lawyer convinced him that it was okay to accept a check instead of cash.
What the foreigner did not know is that the so called “buyer” Ashraf Ezzat Mohammed el Amir signed his name on the check using a special pen that contained magic ink that disappears about one hour after signing; which means that the foreigner lost all his ownership rights on his land without getting paid one piaster out of it.
Fortunately, thanks to the very fair and efficient Egyptian judicial system, justice has been served since this regrettable episode took place. The first thing the foreigner did, right after reporting this vicious scam to Egyptian authorities, was to immediately replace his lawyer, with a much more respectable one. His new lawyer is, as a matter of fact, currently working on having the fraudulent sales contract canceled by the court so that the land can be returned to its previous owner as soon as possible.
As far as the perpetrators are concerned, Ashraff Ezzat Mohammed el Amir was recently convicted to 4 months in prison for fraud after appealing a 3 years sentence. Lawyer Alaa Mohammed Hashim, however, has not been convicted yet; but he has been seen trying in several occasions, through various legal ways, to make himself out this criminal prosecution by doing various last minute maneuvers in order to win more time and therefore delay the inevitable - a criminal conviction for fraud.
Fortunately, Alaa Mohammed Hashim’s court appearance has been set for September 24th 2016 at the criminal court of Luxor. If convicted, he will have to go to jail for up to three years and may lose his license to practice as a lawyer for the rest of his life.
Lawyer Mohammed Abdel Hafiz Abdel Baki, however, was much luckier as he was able to escape from criminal prosecution. Unluckily, the foreigner was lacking the required two witnesses for his case to be considered for trial so the foreigner was left with no other option but to use Mohammed Abdel Hafiz Abdel Baki as a witness which means that, his own lawyer, who responsible for cheating his own client, was given the role of a witness instead of a perpetrator.
As of today, both lawyers can be seen regularly in the court of Luxor and representing their clients as if nothing happened. In the meantime, the British embassy in Cairo has posted a memo in their consular section warning foreigners to be very vigilant when dealing with those two and a few other lawyers from Luxor and Hurgada.
